Two Bengallies were subscribing Witnesses to the Signatures of the Defendants: With regard to both it had been proved they were when they signed, Servants of the Defendants or one of them and it was sworn that when the Sheriff’s Officer went to serve the Subporna to give Evidence on One of the Subscribing Witnesses, that Witness ran away to avoid receiving the Subpoena having been told what it was.
And this the Court thought would have been sufficient to admit the Evidence of the Handwriting of the Defendants if there had been no other
