1778. Sittings. [Friday] Feb. 6th.
Mr. Rous was President of the Court where the dispute then was. Cundreb, Swore, it would appear in the books of Soberam, and that Juggutram, the Banyan of Mr. Rous received it for Mr. Rous.
Soberam, Who was a Prisoner for Debt was sent for from the Prison. He swears that he knows Cundreb the Vakeel who was the last Witness: knows there was such a Cause in the Cutcherry as is mention’d; and knows Juggutram was Banyan to Mr. Rous: and he Soberam being by Trade a Shroff or Banker had Dealings with Juggutram, but as to the Sum in Question, he could say nothing without the help of his books which were now lock’d up in his Shop, and his Gomastah who had the Keys was not in Calcutta.
It was order’d, that further proceedings in this Cause, should be deferr’d till to morrow, and that the Sheriff should suffer the Witness to go to this Shop attended by some of the Sheriff’s Officers to look for his books, and to bring with him to morrow into Court
