Mr. Burroughs, In shewing Cause against an Order to restrain the Sheriff from proceeding to sell Land taken in Execution on a judgment confessed. Here Singh he said had sworn part of the Land was his, and part the property of a charity establish’d by the Will of Omichund who died about the year 1758 and whose will was proved in the late Mayor’s Court, but that to restrain the Sheriff from selling the Land on this motion would be to try the title by affidavit.
