A Rule has been made to shew Cause why the Judgment in the Scire facias against Banarassy Ghose one of the bail in this Cause, should not be set aside on payment of the Costs of the Scire facias. The Motion was grounded on a Certificate that before the return day of the Scire facias the bail had surrender’d Mr. Darley the Defendant, but it was shewn that no notice was given of the surrender to the Attorney who sued out the Writ of Scire facias, and a case was shewn to prove that this was necessary, and on this
