This Cause had come on before, on Tuesday Nov. 28th 1777 at the Sittings, see page 56, 58 & 60; It was then withdrawn by agreement between the Parties.
It was now call’d on. The Plaint was for Assault and False Imprisonment. No objection was now taken to the Plaint.
Impey, On reading the Rule for admitting a Justification in Evidence, Mention’d several objections to it, some of which applied only to the wording of it, others to the matter.
Of the first sort one was, that according to the Grammatical Construction of the words the Governor and Council were alledged to delegate authority to themselves, thought it was meant to the Committee. Of the other sort, was an observation, that Practice and usage was mention’d
