Alexander Davidson and exceeds the said Principal and Interest on the said Writing obligatory mentioned in the said Plaint from the said Alexander Davidson to the said Thomas Cotton And out of which sum of sicca Rupees Fifteen thousand the said Alexander Davidson is willing and truly affect to allow to the said Thomas Cotton all the Principal and Interest due to the said Thomas Cotton on the said writing obligatory according to the form of the statute in such case made and Provided And this he is ready to verify and therefore he prayeth Judgment whether the said Thomas Cotton ought to have or maintain his said action thereof against him.
2d Plea. And the said Alexander Davidson for further Plea in this behalf by Cause of the Court here for this Purpose first had and obtained according to the form of the statute in such are made and Provided says that the said Thomas Cotton ought not to have or maintain his aforesaid action thereof against him because he says that after the Execution of the said writing obligatory by him the said Alexander and before the Exhibitions of the Plaint of the said Thomas Cotton against him said Alexander Davidson to wit on the Twentieth day of June in the year of our Lord one thousand seven hundred and ninety one at Fort William in Bengal aforesaid by a certain Indenture of five Parts made on the said twentieth day of June in the year of our Lord One thousand seven hundred and ninety one to wit at Fort William in Bengal aforesaid between the said Alexander Davidson by the name and description of Alexander Davidson of Calcutta at Fort William
