Account was not immediately settled he would be arrested for the Balance which later this Defendant hath been informed by the said Mr. Ledlie and which he believes to be true was accordingly written and that the Sircars and Servants of the said Complainant alluded the said Mr. Ledlie and went over the Items of the said account. That this Defendant not being able to get the said Complainant to come to a Settlement with this Defendant and being [ILL] getting into a Law Suit with him this Defendant prevailed on the late Mr. Davies complied with this Defendants request and as well the said Datteram Turruffdar as his Confidential Servant [ILL] Sircar attended Mr. Davies several times and went thro’ the Items of this Defendants’ account but after two or three Meetings at Mr. Davies’ House, he the Complainant shewed such an inclination for [ILL] and imposition that he said Mr. Davies was obliged and did actually turn him out of his House and advised this Defendant to proceed at law against him immediately which he accordingly did this Defendant therefore most positively Saith that as far from this Defendant wishing to avoid coming to an account with the said Complainant he winced the most eager desire of settling the same amicably and for that purpose gave him repeated opportunities of doing so, as well at this Defendants House as at the Houses of the said Messeurs Davies and Ledlie this Defendant admits that such proceedings as in Bill
