Of the Parties is not subject to the Jurisdiction, it may be perhaps proper to put a question to the Pundits, whether by the Hindoo Law of such a Joint Contract be made, and One of the Joint Contractors can not be found, the other who can be found may be compell’d in a suit against both, to pay the whole Mondy.
Afterward Mr. Davies proposed as a remedy for this inconvenience, that those parties to a Joint Contract who were not subject to the Jurisdiction, might by suggested on the Record, not to be subject to the Jurisdiction,
