the first day of the Term he had spoken to Mr. Gardiner, and shewn him a paper which the Tenant in Possession had given to Mr. Chambers, and ask’d Mr. Gardiner whether he was concern’d in that cause, and Mr. Gardiner answer’d he was, and then Mr. Chambers ask’d Mr. Gardener whether he had done any thing in that cause, and he answer’d No. Mr. Chambers then ask’d whether he would do any thing soon; and Mr. Gardener again answer’d, No: this was the substance of Mr. Chambers’s affidavit; and Mr. Gardener’s affidavit in answer, only stated that he had been ask’d some Question by Mr. Chambers but he did not recollect what cause it related to
