Mr. Brix, Moved to put off the Trial of a Cause on an affidavit of the absence of material Witnesses. My brother Chambers doubted whether such a motion could be made at the Sitting, and he said that the Rule requiring notice of Trial at the Sittings to be given Six days before the end of the Term, was, he supposed for the purpose of giving an opportunity to move in Term to put off the Cause. I said very likely that might be the intention, but suppose the absence of the Witness should happen, after the end of the Term by illness or otherwise? Are we to go on with the Trial though we know the Witnesses for the Defendant can not be got?
Mr. Litchfeild the Prothonotary was directed to search for Rules made at the sittings from the institution of the Court, and Mr. Brix was desired [to?] defer his Motion, till that Search had been made, But afterward Mr.
