1778. Sittings. [Monday] July 27.
=ering it came under a Proviso, he gave up that doubt and agreed with me that we might sit longer than fourteen days. I told him I consider’d the time mention’d in the Charter for the Terms and also for the Sittings to be merely directory, and to prevent our making Sine Cures of our Offices, and that we might continue the Sittings as long as we would, and might now alter the Terms and make them as much longer as we would. He said he doubted whether the Terms might now be alter’d, and said it was inconsistent with the Doctrine of the execution of Powers to suppose they could. I have no doubt the Terms may now be alter’d by the Court when ever the Court think fit so to do, and may again be alter’d as often as the Court think fit, provided they are always such as are consistent with the Charter, and even if the alterations should be inconsistent with the Charter, I do not think such alterations would make the Acts of the Court invalid, or would abolish the Court.
