This was an Action on a Bill of Exchange drawn payable to Mr. Sealey, for Five Hundred Sicca Rupees, by Mr. Stephen Bagshawe, and accepted by Mohun Pursaud since Deceased.
This Cause was set down ex Parte, on the Plaintiff having served a Rule to Join in Demmurrer on Mr. Staples, Attorney for the Defendant, and no Joinder in Demmurrer being enter’d. We were of opinion that the Sitting down this Cause Ex Parte was within the words of the Rule of Practice, but we inclined to think it was not within the true Construction of it, however we permitted the Plaintiff to go on Ex Parte, at the Peril of having the Trial
