self in a material part of his Evidence. And that this order should afterward be drawn out in form from this minute, and enter’d as an Order of the Court in this Cause. And that the like should be done on any future occasion, and in case of an appeal, the order would be sent with the rest of the proceedings to England, and would account for what the Court did.
In the beginning of his Evidence he said the Plaintiff had paid One Thousand Rupees to obtain a Farm for the Defendant and in the beginning of the cross examination he had said he did not know of any money received by the plaintiff from the Defendant afterward he said he had heard of a draft for twelve hundred Sicca Rupees given by the Defendant to the Plaintiff but did not know of any money paid on it of his knowledge: afterward he said he was told by the Plaintiff that the Defendant had remitted twelve hundred Rupees to him and that he had received the money. For this prevarication and contradiction We rejected his Evidence.
Another Witness was produced who was nearly as bad as this. Therefore Judgment for the Defendant
