1778. 4 Term. [Wednesday] Nov. 11.

Mr. Pritchard, and had also undertaken the building of an house for him. This action was brought to recover the balance due to Mr. Pritchard on the true State of his account with the Defendant as the Plaintiffs alledge, for they say the Defendant has greatly overcharged the building, in the account deliver’d in by him. The Defendant says the Balance is in his Favour, and has given a Notice of Sett-off in this Cause, and has also set down for Trial a Cross action by him against the Executors of Pritchard, in which they have given a Notice of Sett-off.
The Merits of both these Causes depended on the Value of the Building: it was proposed by the Court, and agreed to, by the Parties, present in Court, to refer both Causes to the Arbitration of Mr. Tiretta an Architect, who was present in Court and accepted the Reference, on it’s being directed that she should have for his trouble in surveying the House, to enable him the better to Judge of it, One Thousand Rupees, to be added to the Costs and
