but I think the Dammages too small.
Impey in giving judgment said, the Plaintiff if he had come with clean hands might have deserved larger Dammages, but he had been guilty of three faults, 1st He seized the Colonel’s Servant, either to carry him to Mr. Playdel or to Colonel Watson; He had no right to do either. 2dly He wanted to abuse his authority under Mr. Playdell, by extorting Five Rupees from Colonel Watson’s Servant. 3dly He instructed his Council to say he was flogg’d with a Corrah, when he must know it was a Rattan, and he tried to induce the Court to beleive it was a Corah, by the first Witness, who saw the Marks, but did not see the flogging.
