The bond dated Sept. 1774.
Both the Subscribing Witnesses were dead. Their hands were proved. The Defendants attempted to prove duress, and they attempted to prove the Witnesses were not present at the Execution, on which Mr. Griffin was call’d who swore that he talk’d with Ellington the Subscribing Witness who told him he was present and saw the bond executed, and that no force was used.
