Griffin before any warrant was granted. I never spoke a word to Mr. Hickey on the subject. I might have spoke to him at Mr. Justice Hyde’s, but I do not recollect it. Mr. Hickey did not speak to me on the subject. As I recollect I never at any place spoke to Mr. Hickey on this subject.
Q. You have given the Court a particular account positively & without saving yourself under the word recollection of what passed on the subject night of the 14th at Mr. Tyler’s, why do you not now speak with equal certainty & without saving yourself under the words to the best of my recollection as to different particulars relative to the same subject which happened on a subsequent day.
A. Mr. Hickey never spoke to me on the subject of Mr. Griffin; he might speak to me about Barnet but I do not recollect it.
I did not go to Mr. Hickey’s own house to speak to him on the subject of the warrant against Barnet. I do not know that I ever spoke to Mr. Hickey about Mr. Griffin or that he ever said any thing to me about Mr. Griffin . – at that time I did not know Mr. Griffin’s name. I never did to my knowledge speak to Mr. Hickey on the subject of Mr. Griffin.
