his word as a Gentleman. Fredt Deatker said there was a number of Gentlemen Europeans and he was going to take them to Mr. Justice Hyde’s, but on Mr. Tyler’s passing his word as a Gentleman he permitted them to remain there. I know the house Mr. Griffin was afterwards taken to by Fredk Deatker. It is a place that Constables take persons to who are taken up until the time arrives for taking them before the Justice. A family lives in the house – Fredk Deatker holds the office of a Constable.
Cross Examined.
I do not know what Countryman the Defendant is. I never did hear the Defendant Fredk Deatker swear at this Sessions in the case of Mr. Stuart that he Fredk Deatker was a Dutchman. I do not know the name of the Peon that pointed out Mr. Griffin to me. I knew Mr. Griffin perfectly well when I saw him when I saw Mr. Griffin, on recollection, I knew perfectly well that he was the Gentleman. The Peon came & told me (when I was recollecting & was sure that Mr. Griffin was the man) that was Mr. Griffin. The 1st time I ever saw Mr. Griffin was the night he beat Edwards.
