said this was not proof of the Note, because the Note was not shewn to the Defendant. A Bengally was also call’d to prove the Note, he could not read English, but he swore he saw the Defendant sign it. He said he knew it by his own Bengal writing on it, he said he wrote it the next day, and that in the interim the Plaintiff kept the Note. Impey said, Then it may not be the same Note. And there being no Witness present to prove the Defendant’s hand writing, there was, by direction of the Court, a Non Suit.
