as his reason for suspecting that Da Costa, had not in reality paid the Money to Bayne and Colvin, was that he was refused to have the Powers sent to him for his inspection, by which Bayne & Colvin demanded and received the Money: the answer to this was that Mr. Hamilton drew the Powers by which Bayne and Colvin cited, which were a substitution of them by Mr. Claud Alexander, who was Attorney to Mr. John Herbert, brother and Executor
