Mr. Da Costa intending to send these Deeds and Papers to Mr. Lherondelle deliver’d them to an Hircarrah with Orders to carry them to Mr. Lherondelle, but the Hircarrah deliver’d them to Mr. O’Donnell, and when Mr. Lherondelle demanded from Mr. O’Donnell the Papers, by a Letter, the answer was written by Mr. Hamilton that the Papers were in Mr. Hamilton’s Possession, and he advised Mr. O’Donnel not to return them.
On a future negociation Mr. Hamilton return’d the Deed but reserved a Copy, and on the Trial the Deed was produced by
