[Henry Swinhoe, of the Town of Newcastle upon Tine, was admitted an Attorney and Proctor of this Court. He produced his Admission in the Court of King’s Bench in England Feb. 10th 1775.]
The Injunction had Issued, in the last Vacation, by my Order, to stay Execution untill answer and further Order. This Impey said was right to be done by a single Judge on Petition, and proper Grounds, in Vacation. The Motion was to set it aside for irregularity, no summons, having Issued to the Attorney for the opposite party to shew cause against it. I said I took it to be regular notwithstanding the omission of that notice, for that in England the Injunction till further answer was of Course, and our practice here, differ’d only by having determined that here they should not be of Course, but the substance of the Bill should be verified by affidavit, which was done in this
