Mr. Tilghman, Moved for a New Trial in this Cause, which was tried at the last Sittings.
The foundation for this Motion was that Mr. Stark the Plaintiff’s Attorney had inform’d the Defendant’s Vakeel, the Cause would not be tried in less than a Month, and it was tried within a few days afterward, before the Defendant’s Witnesses arrived: The affidavits also contain’d a contradiction of the evidence of the principal Witness to the Imprisonment, and a charge that that Witness was bribed.
Impey. The misinformation given by Mr. Stark is not a reason for a New Trial, because you have your remedy against Mr. Stark, if you have been injured. But
