Mandamus was begun and had made some considerable progress before Sir Robert Chambers came, after he came, some doubt was expressed at the Bar whether the Court were authorised to Examine Witnesses on the part of the Defendant, and on considering the Words of the Statute and of the Writ the Court were of Opinion Witnesses might be examined for the Defendant, although the Words both of the Statute and of the Writ are in some degree obscure
