Mr. Newman moved, to revive against Mr. Cree Executor of Mr. Whittall, a Decree of the Mayor’s Court that Mr. Whittall should pay a large sum to the Plaintiff; Mr. Newman now applied for a Rule to shew Cause why the Decree should not be revived against the Executor, which Mr. Newman stated to the Court to be the Practice of the late Mayor’s Court, and to have been adopted by this Court. Mr. Sealey, stated several objections to the Decree, the Principal of which was, that the whole proceedings in the Mayor’s Court, were after Mr. Whittall had left Bengal, and were therefore not warranted by the Charter of the Mayor’s Court.
