Mr. Newman. This Cause which is of a Particular Nature, for criminal conversation, with the Plaintiff’s Wife. We are obliged to apply for the Indulgence of the Court to put off the Trial of this Cause and save our Notice of Trial for a few days as the Court may think fit; for the absence of a material Witness. We have used our utmost endeavours to subpoena Mr. Shee, who is a very material Witness, & has gone away to Chandernagore, as we suspect, purposely to avoid giving Evidence in this Cause, and secretes himself so carefully in Chandernagore, that we have not been able to serve him with the Subpoena. Mr. Shee being in the Service of the Company, we propose making an application to the Governor-General on which we hope he will be obliged to come down.
