Mr. Brix. Moved to make absolute a Rule to shew Cause why there sho’d not be a Rule New Trial.
The Record was produced in Court by Mr. Brix for the Defendant, the Evidence in the Cause was read, and the affidavits on which the Rule Nisi was granted.
There were Seven affidavits made in answer. The Court were all three of Opinion the affidavits on which the Rule had been granted were fully answer’d, and the Rule was discharged with Costs. Impey recommended to the Plaintiff to put the matter into some way in which Seedam might have an opportunity to answer the maters against
