=tortious is too often the Case here, and several People have made their fortunes by getting administrations.
Impey. I do not think we are bound to weigh nicely the Debts due to the Petitioners. There seem not be much merits of either side, and therefore I think there is no reason to take the administration from the first applicant. Let the Caveat be discharged with Costs.
Hyde I am of the same Opinion.
I said to Impey it would be very right to have some advertisement publish’d in England of the Deaths of those who die here, that their Relations in England may inquire after the effects.
Impey said he would have such an advertisement publish’d, and a List of Sums of money in the Company’s Treasury paid into the Compan under the Order of the Late Mayor’s Court.
Oldham was ask’d by me, when he came to make an affidavit, if he knew what part of England Rocke came from, and he said from Ludlow.
