Mr. Newman, On affidavits that Mr. Shee was a material Witness, and that it was suspected he had absconded for the purpose of avoiding the Service of a Subpoena to give Evidence in this Cause. Moved to put off the Trial till to morrow. Mr. Tilghman who was Advocate for the Defendant consented, and therefore a Rule was made absolute, instead of a Rule to shew Cause to morrow as was moved.
Impey, on occasion of this Motion said; Probably, if, when this Cause comes on, the Plaintiff’s Advocate will call Mr. George Shee for the First Witness, and he should not appear, the Court will put off the Trial on the Motion of the Plaintiff’s Advocate, till Mr. Shee can be found, and yet Mr. Shee
