of the Goods who is in England, and Mr. Reynold Thomas the Agent of Mr. Thomas Ley, and Mr. North Naylor his Attorney Defendants, and had prayed in his Bill an Injunction till answer and further Order, and a discovery whether the Consideration was not the Sale of the Goods from Mr. Geed, and whether Mr. Ley had any authority from Mr. Geed to receive the Money. There was an affidavit verifying the allegations of the Bill.
Impey. You lay no Ground for an Injunction, Mr. Huggins ought to have been satisfied that Mr. Ley had sufficient authority to receive the Money, before he had given him the Bond. It is manifestly only for delay that this Injunction is moved. This was refused. But afterward it was moved again for an Injunction till the answer of the two Defendants came in, and this Motion was consented to, by Mr. Newman, for Mr. Naylor and the other Defendant who is here.
