the Burglary, on Mr. Justice Hyde’s stating to the Jury that the Evidence proving there had been at least an hour of day light before the stealing was discovered and therefore they could not convict him of Burglary but if they beleived the Witness there was full Evidence of the Larceny independent of any Evidence obtain’d by promise of Favour. On this the Jury found the Prisoner.
Guilty of Grand Larceny as charged in the Indictment
