1786. Sessions. [Saturday] Dec. 23.

alledging that the Witnesses are Sailors, who are going on a Voyage that will last Eight or Ten Months, and that therefore the Indictment can not be tried the next Sessions, and thereby there will be danger that the Defendant may escape for want of Prosecution.
Mr. Church, Now moved on the affidavit of the Defendant, who swears to the absence of several material Witnesses named in the affidavit, to put off his Trial to the next Sessions.
The Court were all of Opinion on the authority of Blackstone’s Commentaries and other Books
