That it was not however necessary in the present case, to determine absolutely whether or no the nat: of the Sec: alone sh must constitute the principal Credr because Mr. Bondfield is a Credr to a higher amount than either Palling or Perreau, & he is a Credr by Judgement. I thot he ought to have the Admon on Condon that he wod enter into articles & bond of average to pay P. & P. & the other bond Credr M: Wilmot pro rata, after paymt of his own Judgement Debt.
Mr. Justice Hyde agreed to this conclusion, but gave no absolute opinion on the question whether the nat: of the Sec: alone constitutes Pr: Cred:
