recd only 1800, tho’ he had execd a bond for the whole.
That he afterwards at difft times repaid a great part of the 1800 Rs. So that only 70 Patna S.R. remd due.
That he cod have proved all this by Wtses to be brot from Patna, but his Atty – Mr. Hamilton told him it was necessary, as he was only a sojourner here and therefore would not be consid: by the Court as subject to the Jurisdon.
That at the Trial, the Court held him subject to the Jurisdon, & he was put upon his defence without the benefit of that Testimony which was necessary thereto.
