cause have leave to pay 50 SR into Court on his Plea of the General Issue filed in this cause Upon the motion of &c –
On comparing this with the 37th or 38th standing Rx of the Court, the Court was of opinion that the Plf not having recd his costs, though Demanded had a right to proceeded in his action, bec: he has no other remedy for them, but that to avoid a nonsuit according to the Lr of the Standing Rule, he must prove his case & that more than 50 SR are due. He will then have Judgemt for 50 SR & costs but must take his Execution only for the costs having recd the 50 SR since plea pleaded.
