the application had been made so late by reason of the great length of the Answers, and was made as soon as the Plaintiff could, after he could get the Exceptions ready.
I [John Hyde] gave for additional reason, why this rule should be made absolute that it would save expence to both Parties, for if the Plaintiff wanted a further answer, he might obtain it two ways, either by amending his Bill, and requiring a further answer or by dismissing this Bill on his own Motion, and filing a New Bill, which would be much more expence than to make the present answer compleat.
The Rule to file the Exceptions Nunc pro Tunc, was made absolute.
