After hearing motions on the Plea side, the Court directed the Session of Oyer, Termr, to be opened by proclaim— which had been adjourned to this day at the request of Mr. Church in order that he might have an opportunity of making 2 motions in fav:r of prisrs, one of which is now made.

not arraigned because on comparing the Ind: with Depos—s taken before Sir W. Jones, I fod that Rinaldo who ought to have bn ind: as accessory before the fact, had bn indicted as principal.
