A Serjt in the Compy’s Service, that he was sent about 9 o’clock on the night of the murder, to search publick houses for suspicious persons. In the house of Rinaldo he fod only one man beside Rinaldo & that man was sick.
Notwithstanding these affidavits the Court thought the Suspicion under which the prisr lies to be very far from a light suspicion and therefore rejected the motion.
The other motion which Mr. Church intended to have made was dropt.
