Had Mr. Petrus and her son set forth in their answr, what they now pretend, that not to have sued the bond wod have been a devastavit of Coja Petrus’s estate, the Complaints would have had an Opportunity of proving that Coja Petrus left more than enough to pay all Debts & Legs & that they were themselves the residuary Legatees, and cod not by anyone be charged wth a devastavit.
