writing and they had had them in that manner. As to presenting Nuisances, some had formerly been presented, and as they must be matter of notoriety, if none were presented he should conclude none now existed.
The only offence not in the Calendar which may probably come before you, is this, two young Men, went out to fight a Duel: unhappily one of them was kill’d. This is a kind of case in which Juries think they have great latitude. That you may know the sentiments of one of the best of Men as well as one of the greatest Lawyers I will read you, an Extract I have made, of the opinion of Lord Cheif Justice Hale, on the duty of the Grand Jury in such a Case. He then read the Extract from Hale.
He concluded by observing that their Oath express’d their duty, and he had no doubt they would observe it.
