1777. Sessions. [Monday] Dec. 15.
to search for a Girl, who she call’d the Daughter of Deepoo Bhy the Prosecutrix, who had before, as Ucloo said been Taken by fraud from Deepoo Bhy togather with Uclu herself, and who Uclu expected to find there. She said while the Prisoner was looking about the House for this Girl, Uclu saw the Sepoy steal the Gold Beads.
I then said to the Jury if they had any doubt I would go through with the Evidence, but it appear’d to me now to be proved that here was no felony, though the breaking the house was a Trespass, and not coming there for the purpose of committing a felony, even if it were true as this Witness said, that a felony had been committed by the Sepoy that would not charge the Prisoner, no more than the European, or other Persons there, with the Guilty of the Felony committed by the Sepoy. The Jury express’d themselves convinced that no felony was committed; and without going through all the Evidence brought in their Verdict Not Guilty.
