Second issue, we have proved both issues.
Impey. We have consider’d of that and we are all of Opinion, that the Evidence that may be given on the Second issue, can not be applied to the first. The judgment on the Plea to the jurisdiction must be given on the Evidence we heard on Friday and not on any Evidence taken hereafter.
Mr. Newman. Then I consent to go on now with the Trial of the General Issue.
Mr. Sealey, Advocate for the Plaintiff. I hope your Lordship will determine first the Plea to the Jurisdiction. We have no objection, if the Court think fit to delay the judgment on the Plea to the jurisdiction till next Term.
Impey. The Court do not call on you for a Consent: you for the Plaintiff who say the Defendant is subject to the jurisdiction, ought to be ready to go on with the proof of the Debt: you must go on now.
