To the ground, with both the prisoner’s hands & feet, giving to the sd Andrew, as well by the casting & throwing him to the ground, as by the striking beating & kicking in manner aforesaid, sevl mortal bruises of which the said Andrew then & there died. And so the Jurors say that the prisr felonly, willfully & of his malice aforethought did kill and murder the said Andrew Starkey. And they further present that the prisr was a Brit Subjt residt in Bengal at the time of committing the felong & murder aforesd & that he is subj to the Jurisdon &c, and further that the prisr at the time of committing &c was in the Service of the United
