This was an Action on the case, for Money Lent and the Evidence was a Bengal Promissory note.
On the part of the Defendant it was proved that the Sum mention’d in the note, was made out, by calculating interest at Twelve per Cent on Sums lent at Several times, and adding to that Interest further Sums, by the name of profit or premium.
Mr. Sealey for the Plaintiff, urged, that this Evidence was not admissible on the Plea of the General Issue, Non-assumpsit: but the Court were clearly of Opinion it was. Mr. Sealey, Then
