Sum of [ill] 1 rs 8 ay & being so liable the said J S afterwards to wit on the 1 Jan 1788 did refuse & neglect to pay the same and upon such refusal & neglect afterwards to wit on the 31 Mar 1788 at Fort William aforesaid in the Province aforesaid Thomas Dashwood Esq being then a person duly appointed by the GG Col of Fort William aforesaid to collect & levy the same rate & tax (by Summons or notice in writing which said Summons of Notice in writing to wit on the same Day & Year last aforesaid at Fort William aforesd in the province aforesd was signed by the said W. G. Honycomb who then was and now is the Clerk to the said Commissioners) did duly summon or cause to be summoned the said J. S. to be and appear before the said Commissioners at the Commission House in Calcutta on the 2d April then next ensuing which said summons was left at the dwelling house of the said j.s. on the ds 31 March & the Plf avers that on the 2d of April 1788, the sd J. Swift appeared before the Comrs, but did not offer any cause of excuse wtsoever agt the payment of the said rate, whereupon the Comrs, or the major part attending &c, on the 16 Apr 1788, by writing under their hands & seals did adjudge that the sd J. Swift shod pay to sd T. D. or to any other lawful Collr of Dep Collr for the time being SR 67 8 A for the sd Tax and Plf further says that on 2 May 1788 notice in writing of the said adjudication was given to & left with the sd J. S. at his dwelling house aforesd & the said J.S. was then & there required by John Regally being a person authorized thereto by the said T. D. to pay the said sum of 67 Rs 8 & the said H. G. H. in fact avers that the sd J. S. although by the sd adjudication adjudged & required to pay the sd sum of 67 SR 8 hath not within 3 days after the sd notice & demand nor at any time since paid the same or any part thereof but hath refused & neglected to pay the same against the form & effect of the Rule ordinance & regulation aforesd whereby afterwards to wit on the 11th June 1788 an action accrued to the said H. G. H. the Clerk to the Comrs aforesd to demand & have of the said J. S. double the sum so adjudged that is to say the said sum of 135 SRs.
