1781. 1 Sittings. [Thursday] Feb. 8.
Plea, was of matter within his own knowledge, and was proved, to be false.
In this Cause, it was proved, the family house, in which both the Deceased and the Administrator who was his brother had lived, was put up to Sale, at a very short Notice, not more than three days at the utmost, and was brought in by the Witness who was a Relation and dependant of the Administrator, and was advised by the Administrator to go to the Auction and buy it, telling him it would be sold for a trifle, and was immediately Mortgaged for the whole purchase Money, which the Court thought strong Evidence of Fraud and of a collusive Sale, and admitted the Plaintiff to prove the Value of the House, in order to charge the Defendant, with what he might have sold the House for.
It was proved to have been sold for 7200 Sicca Rupees in 1779, and it was said at that time for 2 it would have sold for 20,000 Rupees, but Land being much fallen in Value, at present by the
