Ram Ram Bose said he was employ’d by a Mr. Waddel as his Sircar, and by his direction hired this house, and hired first One Savory as an English Writer for Mr. Waddel, and afterward hired Bailey in the same capacity. But that in this transaction with Shaw Mahommed he only acted as Broker for Shaw Mahommed and sold these Cloths to Ramjoy and Ramjoy had given a Bengal Note for the value agreed on.
Ramjoy said he was only a Sircar under Ram Ram Bose, who told him he was Banyan to Mr. Waddel who was expected in Calcutta. That he had nothing to do in this transaction except writing a Bengal Paper by the order of Ram Ram Bose, after these things had been sold when Shaw Mahommed began to be clamorous for his Money. And this paper being produced appear’d to be an account as of goods sold not to Ramjoy, but to another man.
Shaw Mahommed swore he would not have trusted Ram Ram Bose, nor Bailey but that he was deceived by the Story of Bailey being Chief of Assam and a Rich Man. The Chief Justice said, and Chambers and I, by silence assented to it, that the taking a security after the sale, would not make that a fair
