in the Calendar of Prisoners Thirty and upward are committed for a Riot. The Riot Act passed in the Reign of George the first will not come in question in this Case. Lord Chief Justice Hale says when it is clear who was kill’d and by whom, it is best, both for Publick Justice and for the Person accused, that the Grand Jury should find the Indictment for Murder.
