agreed between them that the said Francis Peacock had previous to the date of the said Agreement, [ILL] to several Merchants in the Purnea and [ILL], several sums for the purpose of cutting down Timber for his use to the amount of 26,000 Patna Sonat Rupees, and also the sum of 2600 Patna Sonat Rupees on account of the Sum of the lands such sums of money were to be [ILL] for, and considered as part and parcel of the advance to be made by the said Francis Peacock; And by the said articles it was also agreed that the Appellant should be the Agents or Person in Calcutta, to whom the Timber cut down and transported should be sent, for the purpose of being sold on the partnership account and that the said Francis Peacock should be answerable and responsible to the Appellant for all outstanding balances in the purnea and the [ILL] Countries; and that the Appellant should be answerable and responsible to the said Francis Peacock for all sums of money arising from the sale and disposal of Timber and
