this Defendant was entered into by them which this Defendant humbly Conceives will shew the said Complainant to be wrong in many instances, particularly when he says he was to be allowed one hundred and forty rupees per month that the Defendant was to be allowed [ILL] per Cent when in fact it was Ten per Cent, and that the only Property therein mentioned that was good for anything (same and except a [ILL] Securities for money (were all incumbered by the said Complainant previous to this Deponents intermeddling therewith and Consequently naked and valued much beyond its intrusive would this Defendant denies that the said last mentioned Papers in the Bill called an assignment was [ILL] executed or intrusted to be executed by this Defendant And this Defendant farther answering Saith he admits that in or about the Month of August one thousand seven hundred and eighty eight the said Complainant applied to this Defendant (but this Defendant positively denies his ever Solliciting him to do so) and represented to this Defendant that as he this Defendant was then greatly in advance for the said Complainant to the amount by his own estimate of twenty thousand Rupees and upwards and as he was apprehensive that the said Jaggernaut Sercar or some ill disposed Creditors might Seize his Lands he the said Complainants as well for securing this Defendants debts as for protecting his property from Creditors was desirious of granting this Defendants
